Executive Summary: Getting a Succession Certificate in Karachi
What the service is
We prepare and file the succession petition, arrange publication of the notice, attend hearings, answer any objections and, once the certificate is issued, help the heirs present it to banks, share registrars and savings centres. Where immovable property is involved, we advise on letters of administration instead.
Who needs it
Widows, widowers, children and other legal heirs of a person who died leaving bank balances, fixed deposits, shares, savings certificates, provident fund or other amounts owed to the deceased. Institutions generally will not release such amounts to heirs without a court grant or another authority they accept.
Fee basis
Our professional fee is quoted after the documents are reviewed. It depends on the number of assets, the number of heirs, whether any heir objects and which court has jurisdiction. Court fee is payable separately on the value of the debts and securities, as the court-fee law provides.
Time it usually takes
An uncontested petition commonly takes a few months from filing to grant, because notice must be published and a date fixed for objections. Objections, missing heirs or incomplete records can extend this considerably. We give a realistic range after reading the papers, never a guaranteed date.
How to start
Send the death certificate, the deceased's CNIC, the NADRA Family Registration Certificate and a list of accounts or shares to +92 333 1127830 on WhatsApp. We check that the heirs are correctly identified and list what else the court will need.
Advocate-led since 1985
Succession work is led by Syed Akhtar Rizvi, Advocate Supreme Court, with Shankar Lal Kataria, Advocate High Court, who handles property and title issues. The firm has about 17 advocates and has practised in Karachi's courts since 1985.
What a Succession Certificate in Karachi covers — and what it does not
Under Part X of the Succession Act 1925, a succession certificate relates to debts and securities owed to the deceased: bank balances, fixed deposits, shares, bonds, savings certificates and similar amounts. It authorises the holder to collect them and gives a good discharge to the institution that pays.
It does not transfer title to land, flats or houses. Immovable property normally needs letters of administration, probate where there is a will, or the relevant authority's own mutation procedure based on proof of heirship. Choosing the wrong grant wastes months, so this question is settled first.
Which court issues a Succession Certificate in Karachi
The petition is filed where the deceased ordinarily resided at the time of death. In Karachi, depending on the value of the estate, it is heard either by the District Judge of the relevant district or by the Sindh High Court on its original side. The value limits change from time to time, so we confirm the correct forum before filing.
Documents for the petition
- Death certificate issued through the Union Council or Cantonment Board.
- CNIC of the deceased and of every legal heir.
- NADRA Family Registration Certificate showing the family tree.
- Bank statements, share certificates or account details for each asset.
- Nikah Nama or marriage certificate of the surviving spouse, where relevant.
- Guardianship details if any heir is a minor.
- Consent affidavits or powers of attorney from heirs who support the petition.
Step-by-step court process for a Succession Certificate in Karachi
- We draft the petition stating the date and place of death, the heirs, the petitioner's right and the debts and securities claimed.
- The petition is filed with the court fee and supporting documents.
- The court fixes a date and orders notice to the heirs and publication in a newspaper.
- The publication is carried out and proof is filed in court.
- Any objections are heard; if none are received, evidence of heirship is recorded.
- The court may require a surety or security bond from the petitioner.
- The certificate is issued, listing the debts and securities it covers.
Once issued, the certified certificate is presented to each bank or registrar, which then transfers or pays the amounts according to the shares of the heirs.
Publication, notices and objections
Publication gives anyone with a claim, including an heir who was left out, an opportunity to object. A notice is also sent to the known heirs. If an objection is filed, the court decides who has the better right and may require evidence, which lengthens the proceedings.
Most objections arise because an heir was omitted, a second marriage was not disclosed, or heirs disagree about who should collect the funds. Listing every heir honestly at the start, supported by the Family Registration Certificate, is the best protection against later challenge.
Succession Certificate in Karachi compared with other grants
| Grant | Used for | Typical situation |
|---|---|---|
| Succession certificate | Debts and securities: bank balances, shares, savings certificates | Heirs need a bank or registrar to release funds |
| Letters of administration | The estate generally, including immovable property | House or plot to be transferred to heirs, no will |
| Probate | Proof of a will and authority of the executor | The deceased left a will naming an executor |
| NADRA SFU certificate | Succession or letters of administration through NADRA | Only where the facility is available and heirs agree |

Letters of administration for immovable property
Where the estate includes a house, flat or plot, heirs usually apply for letters of administration. Once granted, the administrator can deal with the property for the benefit of all heirs, and the authority or society can transfer it according to each heir's share under the deceased's personal law.
If a minor heir is entitled to a share, any sale of the minor's interest generally needs permission of the guardian court. Our Property Lawyers in Karachi handle the transfer stage once the grant is obtained.
Bank accounts, shares and savings
Bank accounts and deposits
Banks usually freeze the account on learning of the death and release funds on a court grant.
Shares and securities
Listed shares are transmitted to heirs through the company's share registrar on the certificate.
Savings certificates
National Savings instruments are encashed or transferred against the certificate and heirs' documents.
NADRA Succession Facilitation Units, where available
The Letters of Administration and Succession Certificates Act 2021 created NADRA Succession Facilitation Units, initially for Islamabad. Where such a facility is available and all heirs agree, it can be quicker than court. In Sindh, succession certificates are ordinarily issued by the courts, so we advise which route actually applies to your case.
Disputes among heirs in a Succession Certificate in Karachi case
Heirs' shares are fixed by the deceased's personal law, not by agreement alone. Disputes about who is an heir, an undisclosed marriage, gifts made before death or debts owed by the estate may need evidence and, sometimes, a separate civil suit. We try to settle these by written family agreement where the law allows.
Heirs living overseas
Heirs who live abroad do not usually need to travel to Karachi. They can sign consent affidavits or a power of attorney before a Pakistani embassy or consulate, or before a notary with the attestation the court accepts. We send the drafts in advance so that the documents reach Karachi before the hearing at which they are needed.
After the certificate is issued
The court issues the certificate with a schedule of the debts and securities it covers. Each bank or registrar keeps a certified copy and may ask for the heirs' CNICs, an indemnity or its own claim forms. Where an asset was missed from the petition, the certificate can be extended by a further application rather than a fresh case.
Avoiding delay in your Succession Certificate in Karachi
- Obtain the death certificate and Family Registration Certificate before filing.
- Collect account numbers and approximate balances from bank statements.
- Make sure names on CNICs match those on bank and share records.
- Ask heirs living abroad to sign consent documents early.
- Attend every hearing or ensure your lawyer has instructions to proceed.

Frequently asked questions
What is a succession certificate used for?
It authorises the holder to collect debts and securities owed to the deceased, such as bank balances, shares and savings certificates. The paying institution receives a legal discharge. It does not transfer ownership of land or houses, which normally need letters of administration.
Where do I apply for a succession certificate in Karachi?
In the court of the district where the deceased ordinarily resided. Depending on the value of the estate, that is the District Judge or the Sindh High Court on its original side. We confirm the forum against the current value limits before filing.
How long does it take?
An uncontested petition commonly takes a few months, because publication and a hearing date are required. Objections, missing documents or disputes between heirs can extend this. We do not guarantee dates, but we keep the file moving and report after each hearing.
Do all heirs need to come to court?
Not always. Heirs who support the petition can often sign consent affidavits or appoint an attorney. The petitioner and witnesses to heirship usually attend. Heirs abroad can execute documents at a Pakistani mission.
What if one heir objects?
The court hears the objection and decides who has the better right to collect the debts and securities. Evidence may be recorded, which takes longer. Many objections can be resolved by a written family agreement consistent with the heirs' shares.
Is court fee payable?
Yes. Court fee is payable on the value of the debts and securities covered by the certificate, at the rate set by the court-fee law. Our professional fee is separate and is quoted after the documents are reviewed.
Can NADRA issue a succession certificate instead of the court?
NADRA Succession Facilitation Units were created under the Letters of Administration and Succession Certificates Act 2021, initially for Islamabad. Where the facility is available and heirs agree, it may be used. In Sindh, courts ordinarily issue succession certificates.
Does a succession certificate transfer a house?
No. A house, flat or plot normally needs letters of administration or the authority's own transfer procedure on proof of heirship. We advise which grant fits the estate before anything is filed.
What if a legal heir is a minor?
The minor's share is protected. A guardian may need to be appointed, and the court may give directions about how the minor's share is held. Selling a minor's share of property generally needs the guardian court's permission.
